What Is Military Medical Malpractice?
Military medical malpractice happens when a government-employed healthcare provider fails to meet accepted standards of care, resulting in a patient’s injury, illness, death, or worsened health condition. Unlike civilian malpractice cases, these claims are brought under the Federal Tort Claims Act, which governs how individuals may hold the federal government accountable for negligence.
Examples of military medical malpractice include:
- Birth injuries
- Medication errors
- Stroke misdiagnosis
- Heart attack misdiagnosis
- Surgical mistakes
- Hospital negligence
Our firm has successfully litigated many of these case types, often against the Department of Veterans Affairs, the Army, Air Force, Navy, and Department of Health and Human Services.
Military Medical Malpractice in Galveston
Galveston serves as a key healthcare region for active-duty personnel, veterans, and military families throughout southeast Texas. Patients in this region may receive care through both VA and military-connected medical systems, where errors can have devastating results.
Military and VA medical malpractice may occur at or be connected to facilities such as:
- Galveston VA Clinic
- Michael E. DeBakey VA Medical Center (serving Galveston-area veterans)
- USCG Clinic Houston/Galveston
Our attorneys have the experience to evaluate your potential FTCA claim and pursue compensation through the appropriate federal channels.
Federally Funded Clinics
Did you know that some small clinics that appear to be privately owned clinics are actually “federally funded clinics?” For example, in Galveston the Coastal Health and Wellness clinic is a federally funded clinic. These clinics are a trap for the unwary because they often look and function like ordinary private medical offices, yet some of them are actually “deemed” federal entities for malpractice purposes, which means the claim belongs under the Federal Tort Claims Act rather than a normal state-court malpractice suit. If your lawyer is unfamiliar with the special rules and requirements of suing a federally funded clinic under the FTCA, you may lose your rights to sue. Our firm has decades of experience pursuing claims against these clinics for medical malpractice.
What Can an FTCA Claim Accomplish?
The Federal Tort Claims Act provides a legal path for patients to recover compensation from the U.S. government when negligence by a federal employee causes harm, including when medical malpractice occurs in a VA hospital, military medical center, or on-base clinic. These claims are distinct from typical Texas medical malpractice lawsuits, as they must follow strict procedural steps before any case can proceed in federal court.
Potential compensation through an FTCA claim may include:
- Past and future medical expenses
- Loss of income and reduced earning potential
- Pain, suffering, and emotional distress
- Long-term disability or loss of quality of life
- Wrongful death damages for surviving family members
Our attorneys guide clients through every step of this process, from filing the initial administrative claim to, if needed, litigating the case before a federal judge.

Galveston Military Medical Malpractice FAQ
1. Can active-duty service members file military medical malpractice claims?
In most cases, active-duty personnel are barred from filing FTCA claims in federal court for their own injuries that occurred during service due to the Feres Doctrine. However, spouses, dependents, and veterans receiving VA care may have valid claims. Our attorneys can determine whether your situation qualifies.
There is one exception though. In 2019, the Stayskal Act passed Congress and became the law of the land allowing active duty service members who are victims of medical malpractice to file an administrative claim against the federal government. But the law does not allow active duty service members to file a federal lawsuit against the government for medical malpractice.
2. How long do I have to file a military medical malpractice claim?
Generally, an FTCA claim must be filed within two years of when the injury was discovered or reasonably should have been discovered. Because delays can affect your right to compensation, it’s important to speak with an attorney as soon as possible.
3. What makes FTCA cases more complex than regular malpractice cases?
FTCA claims involve federal agencies, unique jurisdictional rules, and administrative prerequisites that do not apply in state court cases. Missing a deadline or filing in the wrong venue can cause a claim to be dismissed.
