Examples of Military Medical Malpractice

Military medical malpractice occurs when a federal healthcare provider fails to provide appropriate care, resulting in serious injury, illness, or death. Because these professionals are employed by the U.S. government to some capacity, legal claims against them must be brought under the Federal Tort Claims Act, not typical state-level malpractice law.

Common examples of military medical malpractice include:

  • Birth injuries caused by delayed intervention or improper monitoring
  • Medication errors involving wrong dosages or drug interactions
  • Stroke misdiagnosis or failure to provide timely treatment
  • Heart attack misdiagnosis leading to preventable harm or death
  • Surgical mistakes, including wrong-site operations or retained instruments
  • Hospital negligence, such as unsanitary conditions or poor supervision

Each of these errors can cause lasting physical, emotional, and financial consequences. Our firm has the experience and medical knowledge to handle even the most complex FTCA malpractice claims.

We know how to navigate the federal system, gather strong medical evidence, and pursue maximum recoveries. Where Military Medical Malpractice Can Occur in Fort Worth

Fort Worth is home to a large community of active-duty service members, reservists, and veterans who receive medical treatment through local VA and military-connected healthcare systems. While many of these providers deliver excellent care, serious mistakes can and do happen. If negligent care at one of these or a related facility caused your injury, our attorneys can investigate your case, gather medical evidence, and help determine whether you are eligible to file an FTCA claim.

Military and VA medical malpractice in the Fort Worth area can occur at or be connected to facilities such as:

  • Fort Worth VA Clinic
  • Fort Worth Vet Center
  • Naval Air Station Joint Reserve Base (NAS JRB) Fort Worth Medical Clinic
  • Community-based VA clinics affiliated with the North Texas VA Health Care System

What the Federal Tort Claims Act Allows

The Federal Tort Claims Act (FTCA) is the law that permits people to hold the U.S. government accountable for negligence committed by its employees, including medical providers in military or VA settings. Under the FTCA, injured patients may pursue financial compensation for their losses, though the process is very different from typical medical malpractice claims filed in state courts.

Compensation under the FTCA may include:

  • Medical expenses, including surgeries, rehabilitation, and ongoing care
  • Lost income and future earning potential
  • Pain and suffering
  • Mental anguish
  • Disability or loss of quality of life
  • Wrongful death damages for surviving family members

FTCA claims must follow specific administrative procedures before a lawsuit can be filed in federal court. Our attorneys handle every aspect of this process, from filing the initial claim with the proper agency to litigating the case before a federal judge if necessary.

Federally Funded Clinics

Did you know that some small clinics that appear to be privately owned clinics are actually “federally funded clinics?” For example, in Fort Worth the North Texas Area Community Health Center is a federally funded clinic. These clinics are a trap for the unwary because they often look and function like ordinary private medical offices. But some of them are actually “deemed” federal entities for malpractice purposes, which means the claim belongs under the Federal Tort Claims Act rather than a normal state-court malpractice suit.  If your lawyer is unfamiliar with the special rules and requirements of suing a federally funded clinic under the FTCA, you may lose your rights to sue. Our firm has decades of experience pursuing claims against these clinics for medical malpractice.
