Types of Military Medical Malpractice

Military medical malpractice happens when a healthcare provider employed by the U.S. government fails to provide proper care, leading to serious injury, illness, or death. Because these providers are federal employees, claims for malpractice are handled under the Federal Tort Claims Act (FTCA), which is a specialized legal process that differs significantly from state medical malpractice laws.

Common examples of military medical malpractice include:

  • Birth injuries, including those caused by delayed C-sections or improper fetal monitoring
  • Heart attack misdiagnosis resulting in preventable injury or death
  • Hospital negligence, including poor sanitation, lack of supervision, or failure to prevent falls
  • Medication errors, such as wrong dosages or drug mix-ups
  • Stroke misdiagnosis or failure to recognize warning signs
  • Surgical mistakes, such as wrong-site operations or retained surgical tools

Our attorneys are nationally recognized for their success in FTCA litigation. We know how to investigate military and VA medical systems, collect strong medical evidence, and pursue full and fair compensation for our clients.

Military Medical Malpractice in El Paso, Texas

El Paso is home to several major military and VA healthcare facilities that serve service members, veterans, and their families throughout West Texas and even southern New Mexico. While most providers deliver excellent care, serious errors still occur. When they do, they can change lives forever, and it is only right to pursue legal action to try to set things right.

Our firm represents clients whose injuries occurred at or are connected to facilities such as:

  • William Beaumont Army Medical Center (WBAMC) – Fort Bliss
  • El Paso VA Health Care System
  • El Paso Eastside VA Clinic
  • El Paso Westside VA Clinic
  • Fort Bliss Soldier Family Medical Center

Whether your care involved a surgical procedure, emergency treatment, diagnostic testing, or ongoing therapy, our attorneys can help determine whether your injury qualifies for a claim under the FTCA.

How the Federal Tort Claims Act Works

The Federal Tort Claims Act (FTCA) allows people harmed by the negligence of federal employees, including military and VA medical providers, to seek compensation from the U.S. government. However, the FTCA process has strict requirements that must be followed.

Before filing a lawsuit, an injured patient must first submit an administrative claim to the responsible federal agency (often the Department of Veterans Affairs, Army, Air Force, Navy, or Department of Health and Human Services). The government then has six months to accept, deny, or ignore the claim. If it is denied or if no decision is made within six months, the claimant may then file a lawsuit in federal district court.

Our attorneys can handle every aspect of this process, from filing the administrative claim to litigating in federal court if necessary. With decades of FTCA experience, we know how to present compelling cases that pursue maximized compensation.

Compensation in FTCA cases related to military medical malpractice can cover:

  • Disability or reduced quality of life
  • Lost wages and diminished earning capacity
  • Medical expenses (past and future)
  • Mental anguish
  • Pain and suffering
  • Wrongful death damages for surviving family members

Successful military and VA medical malpractice cases do more than provide financial relief; they also deliver accountability. When a medical provider or facility fails to uphold its duty of care, filing a claim helps expose negligence and may prevent future harm to others.

At National Trial Law, we treat every case as an opportunity to make a difference. We often work with top medical experts to evaluate records, uncover systemic failures, and tell our clients’ stories with compassion. Our firm’s record of multimillion-dollar recoveries demonstrates our readiness to take on complex and high-stakes FTCA cases from start to finish.

Federally Funded Clinics

Did you know that some small clinics that appear to be privately owned clinics are actually “federally funded clinics?” For example, in El Paso the Centro San Vicente is a federally funded clinic. These clinics are a trap for the unwary because they often look and function like ordinary private medical offices, yet some of them are actually “deemed” federal entities for malpractice purposes, which means the claim belongs under the Federal Tort Claims Act rather than a normal state-court malpractice suit.  If your lawyer is unfamiliar with the special rules and requirements of suing a federally funded clinic under the FTCA, you may lose your rights to sue. Our firm has decades of experience pursuing claims against these clinics for medical malpractice.
