National Trial Law brought the lawsuit against the United States Air Force (USAF) for failing to enter the gunman’s domestic violence and child abuse felonies into the FBI’s background check system. If the USAF had taken this necessary step, then he would not have gotten the firearms that he used to kill 27 and wound 22 others in Sutherland Springs, Texas. Indeed, reporting domestic violence offenses is specifically designed to prevent potentially violent people from obtaining weapons to hurt others.

Our trial attorneys argued that the U.S. Air Force negligently enabled Kelley to commit the crime, and therefore, was liable for the losses the Air Force caused. After a difficult trial in federal court, the Air Force was found responsible for the attack due to its reporting failure. As a result, Federal District Court Judge Rodriguez awarded $230,331,884.46 on behalf of the victims, which would ultimately be recognized by Texas Lawyer as one of the “Top Verdicts & Settlements of Texas” in 2022.
